Council Bylaws – Know the Rules before you Act!
KDC has a number of Bylaws which set local rules in respect of certain activities which have potential to create hazards or nuisance to the public.
These Bylaws and the activities they control are listed below.
Bylaw Title and Activities Controlled
Traffic and Parking
Parking and other use of roads and footpaths
Structures and Works in Public Places
Placing items or conducting works in roads, footpaths or other public areas
Signs
Display of any type of sign that is visible from public places
Water Supply
Connection to and use of Council water supplies
Drainage
Discharges to Council wastewater and stormwater systems
Trade Waste
Commercial discharges to Council wastewater system
Stock Control
Movement of animals along or across roads
Responsible Camping
Freedom camping on public land
Control of Alcohol in Public Places
Possession or consumption of alcohol in public places
Formal permits from Council are not required to undertake some of these activities, but the activity still must always meet the requirements of the relevant bylaw(s).
Bylaw rules are not negotiable and they must be met. If your activity does not meet the rules it will be required to cease, with potential legal penalties if it does not.
It is therefore important that if you are planning to undertake such an activity you first check what the relevant bylaw rules are. A failure to do so can potentially result in significant waste of time, effort and money by the person undertaking the activity.
